$273 Million Credit Card Co. Fraudulent Fees?

Is Bank of America cheating its customers out of millions?

Bank of America tried to rip us off for $39.00 last month. How many times has your credit card company ripped you off? How many millions of dollars are they ripping us off for every month? Here is what happened.

On our Bank of America credit card statement for November 2006 we found a "Late Fee" charge of $39. According to the statement, our payment was posted on November 2nd and the "Late Fee" was posted on November 1st, the day the payment was due. Did we make our payment late?

Kimberly, my wife, likes making payments electronically. She paid the payment electrically from our BofA checking account, with instructions to make the payment on its due date, November 1st. According to our checking account statement the payment was deducted from our account and paid on November 1st.

So why the difference in dates of payment and posting? Why a $39 Late Fee? Is someone pulling a fast one here? Is this fraud?

Kimberly, called Bank of America to inquire. She was told that the electronic payment from our BofA checking account to our BofA credit card account was probably made after 3:00 p.m. on the due date and any payment received after 3:00 p.m. is posted to the next day. Therefore, our payment was late and a $39 Late Fee is due. WHAT?

So let me get this straight. BofA debits my checking account on November 1st for a payment to my BofA credit card but BofA credit card posts it to the next day because BofA transferred the money after 3:00 p.m. on the due date so I owe a Late Fee of $39.00? Is this insane or is this fraud?

There are 700 million credit card accounts in America. If one percent of the accounts are cheated this way once each year it would amount to $273 million dollars in bogus charges. This is big time fraud.

As I was going berserk at the Bank of America response, Kimberly calmly explained to the BofA operator that her husband was an attorney who loves to represent consumers against corporate rip-offs in class action lawsuits, that this smelled like a rip-off and would BofA like to withdraw this Late Fee charge. The operator told her since we have an excellent payment record they would waive the Late Fee this time. If I had any hair, I may have pulled it out, right then.

Hello John;

I found your blog entry on BofA this morning through Google Alerts on "Credit Card Fraud"

As you probably know, credt card issuers are quite fond of ripping people off and their favorite target is the e-Commerce merchant. I've discovered, both as a merchant and as Director of Merchant911, that issuers will stoop to almost anything to collect fees. The fact that on-line merchants pay higher rates because of the 'added risk,' even though the merchant is always responsible for fruadulent charges anyhow is only the tip of the iceberg.

With over 3300 members, I hear horror stories constantly. There is no bigger legally sannctioned thief than the credit card industry.

Incident = I pay most of my creditors electronically via their web site. The payments may be made in advance of due date or on due date.. Most payments may be accomplished 24/7. NOT BOA!!! BOA requires electronic payments to be made during specific windows of their convenience. It is their policy to find all ways to collect fees from customers who want to pay their creditors. E.g., In November I paid BOA electronically on Nov 11 (Saturday). The due date was Nov 11. BOA charged a $40 late fee because they posted it Nov 13 (a banking business day). I called and vigorously complained to the CSR who advised because this was first time (I have been cardholder since 1978) they would remove the late fee... Then it happened again in January 2007... The BOA due date was 01/15/07 (Monday), On Saturday 01/13/07 I logged on to BOA website to make payment on 01/13/07 (Saturday) The BOA website rejected the 13th as a non-banking day. I changed the date to the due date of 01/15/07 and it too was rejected due to non-banking day (MLK birthday). The only way to make payment was to change the date to Tuesday 01/16/07. BOA forced me to make an electronic payment late and then charged me a late fee of $40. I called to complain an was advised by CSR they would make no adjustments and would not escalate or provide me with any names to escalate this issue to. I believe BOA Business Practices to be \\'Unfair.\\' I will close my BOA accounts including brokerage account as soon as possible and tell as many people as possible about BOA\\'s practices and my experiences.
Damage Resulting = $40 late fee... A dent in my credit rating (which is currently \\'Prime Plus\\') and will take 7 years for dent to go away and the unbelievable arrogance of BOA and their employees as they insisted this was my fault for not understanding their policies. I believe if they have done this to me they have also done this to countless others including those who pay by mail. I strongly believe they need to be slapped down with \\'Class Action Suit\\'. To reiterate, I have never been treated like this from any other creditor.
