Roof Crush Intrusion - "Deadly By Design" Expose

In response to my Dec. 23, 2006 "The Most Deadly Vehicle" article, I received an email from Paula Lawlor, a roof crush consultant, who has co-authored, along with Todd Tracy, "Deadly By Design". According to its authors, "Deadly By Design" is "An expose of the weak government standard that has lead to more than three decades of unnecessary fatalities and catastrophic injuries in rollover accidents". "Deadly By Design" goes through the history and statistics of "roof crush intrusion" or what is sometimes called "roof crush failure" or simply "roof crush".

The conclusion that Lawlor and Tracy come to is:

Year after year, for the past 36 years, thousands of people have unnecessarily died and been maimed due to pathetically weak roof structures that crush excessively during a rollover. Rather than engineer roof designs that promote the idea of preserving

the passenger compartment space, the vehicle industry has made a concerted effort to defend itself in litigation with a defense known as the "diving theory" which has proven to be a hoax.

Having been involved in litigating dozens of rollover vehicle accident cases wherein "roof crush" was responsible for multiple deaths and catastrophic injuries, I am in agreement with the conclusion of the Lawlor/Tracy expose. With ten thousand deaths and 16,000 catastrophic injuries each year due to rollover accidents, why hasn't the auto industry built their vehicles more stable, in order to prevent rollovers and built the roofs to hold up in a rollover accident The auto industries' own data indicates that stronger roofs save lives, yet they fight every attempt to legislate stronger roofs.

Is it any wonder that the American auto industry is continuing to lose market share and billions of dollars annually. Their philosophy of fighting higher standards for automobile safety standards is appalling. They will spend more on cosmetic extras, leather seats, navigation and entertainment systems than they will on safer more reliable vehicles. Maybe their philosophy of building questionably safe vehicles, according to today's technology, and then defending lawsuits with junk science and smoke screens is catching up to them. Maybe if they start "doing what is right" rather than worry about the next quarterly report, it would turn them toward long run profitability and respectability.

Everyone of our rollover/roof crush cases has encountered the auto industry's "diving theory" as well as multiple other defenses. So far we have been successful in ninety percent of our rollover/roof crush cases. We continue to accept and aggressively pursue rollover and roof crush cases that have resulted in a death or catastrophic injury. Litigating these cases is our way of coaxing the auto industry to build safer vehicles for us all and holding them accountable for the harm their negligence has caused.

Deadly By Design is presently being peer reviewed for possible publication in The International Journal of Crashworthiness.

When NHTSA announced its rule for roof strength (FMVSS 216) will be finalized in August 2007, I immediately began making plans for an Emergency World Summit - PEOPLE SAFE IN ROLLOVERS in Washington, DC to bring structural, mechanical and biomechanical engineers together from all over the world to expose the weak U.S. government standard that has led to more than three decades of unnecessary fatalities and catastrophic injuries in rollover accidents and to offer real, simple, inexpensive solutions which will save thousands of lives and prevent so much pain and suffering.

SUMMIT PURPOSE - To inform the motoring public of the devastating ramifiations of the proposed Federal Motor Vehicle Safety Standard No. 216 - Roof Crush Resistance:
- - The proposed standard will not protect from the crushing of the roof into the occupant's survival space in the event of a rollover accident.
- - An automobile manufacturer who meets the proposed standard would be protected from liability should a passenger be killed or catastrophically injured in a rollover roof crush accident.

SUMMIT GOAL - To effect a major upgrade in the proposed Federal Motor Vehicle Safety Standard No. 216 - roof crush resistance before it is finalized in August 2007 requiring dynamic testing.

SUMMIT EXECUTION - To involve National media in a press conference kicking off the 2-day telecast Summit which will include presentations of scientific papers by world renown engineers who have studied ROOF CRUSH in depth, videos of roof dynamic drop test comparisons and vehicle rollover comparisons of strong roofs v. weak roofs, and stories shared by survivors of ROOF CRUSH incidents.

TWO KEYNOTE SPEAKERS AT THE SUMMIT:
- - Professor Clive Chirwa from Engineering and Design Department at the University of Bolton (UK) who was Chairman of ICRASH Seminar in Athens - July 4-7, 2006 and is Editor-in-Chief of The International Journal of Crashworthiness (UK) will present his recent paper entitled "Flaws in Malibu I and II interpretation of test results that have influenced many poor rollover roof designs."
- - Professor Raphael Grzebieta from the Department of Civil Engineering at the Monash University in Victoria, Australia will present his recent paper entitled "Rollover Diving v. Roof Crush" which has also been submitted to The International Journal of Crashworthiness for publication. Professor Grzebieta approached the problem with a methodical analysis of the facts as they stand. He assessed the problem with neutral fresh eyes, looked at both sides of the arguments, acknowledged both sides of the arguments, but peeled away the layers, considering the arguments, and teased the conclusions based on sound undeniable physics, that are inevitable and in the end damming for those lawyers who think one can argue against physics and win. I would like to mention that Professor Grzebieta is a graduate of Krakow's Jagiellonian University in Poland where Copernicus defended his Ph.D. Copernicus was the one that undeniably proved and said, it was the earth that rotated around the sun and not the sun around the earth! Copernicus' defense was carried out in front of professors, clergy and the lawyers of the time, under considerable opposing world pressure, and under threat of being burned at the stake for heresy. When astronauts returned to earth with moon rocks, NASA gave one to the University with a note sayng "Thank you". To quote Professor Grzebieta, "Mathematics and physics cannot be brought down in a court of law by any wizard lawyer or opposing expert, no matter how good they are with their smoke and mirrors."

When I have more information and the exact dates of the Summit I will let you know.
